La justicia interamericana de derechos humanos es un fenómeno de transnacional influencia sobre los ordenamientos jurídicos de los Estados nacionales. La creciente interacción de la Corte Interamericana con los jueces nacionales y su labor como intérprete de la Convención Americana de Derechos Humanos (CADH) ha promovido un excesivo optimismo que resulta necesario revisar críticamente en aras de una mejor comprensión de la justicia transnacional en derechos humanos. Este artigo tem como seu objetivo revisitar a trajetória do projeto interdisciplinar entre filosofia e pedagogia da Residência Pedagógica promovida pela CAPES, no curso de filosofia da Universidade Presbiteriana Mackenzie, na qual, foi desempenhada à luz das categorias de Marli André. A autora preocupada com as questões do cotidiano escolar em especial de 1°grau, se propõe a analisar os estudos etnográficos realizados, e para tanto, nos apresenta como essências três dimensões sendo elas: institucional/organizacional, institucional/pedagógica e filosófica/histórica/epistemológica. À luz de algumas ideias de Freud e Nietzsche pretendemos criar algumas transposições que nos ajudam a pensar sobre o bem ou mal-estar docente, ressaltando que estes estados de ânimo não estão dissociados de nossa condição humana, nem apartados das políticas públicas que norteiam as diretrizes da educação e do status do ofício docente em nosso país. Buscamos extrair destes teóricos da cultura algumas ideias-chave: a arqueologia da cidade de Roma realizada por Freud em O Mal-estar da Civilização para refletirmos (...) sobre aquilo que nos edifica enquanto docentes. No segundo momento, discorremos sobre a fisiopsicologia nietzschiana pois a maneira como olhamos para o mundo e para a docência, determinará, em última análise, o nosso bem ou mal-estar. Por fim, ainda resgatando as ideias do pensador alemão em Assim Falou Zaratustra, encontraremos algumas fontes de inspiração em busca do nosso bem-estar. (shrink)

O Transtorno do Espectro Autista (TEA) é caracterizado pela presença de déficits persistentes na comunicação e interação social, além de padrões restritos e repetitivos de comportamentos, interesses e atividades. Como forma de viabilizar a inclusão das crianças autistas no ambiente escolar, a orientação dos professores que atuam com este público é de suma importância. O objetivo do estudo é apresentar a experiência de orientação feita para os professores que lecionam para alunos autistas, acompanhados pelo Núcleo de Atenção ao TEA, da (...) cidade de Monte Alto-SP, no período de junho de 2022 a junho de 2023. Trata-se de um estudo descritivo, do tipo relato de experiência, embasado na ciência ABA (Análise do Comportamento Aplicada) e relacionado às vivências com os professores em orientações, realizadas mensalmente. Como resultado, observou-se a dificuldade dos docentes em acolher estes alunos, direcionar atividades, lidar com comportamentos disruptivos e no manejo das atividades de vida diária. Discute-se a importância de uma ferramenta de apoio para proporcionar aos docentes maior respaldo teórico à prática com alunos autistas, para contribuir na inclusão, aprendizagem e socialização no ambiente escolar. Esta experiência ampliou as vivências sobre a perspectiva do professor na inclusão escolar de crianças com TEA, lançando luz sobre a necessidade de formação teórica e instrumentalização dos docentes, considerando as particularidades de neurodesenvolvimento e comportamento desta população e contribuindo para a maior eficácia da assistência educacional inclusiva. Este artículo plantea un diálogo sobre la ficción y su relevancia narrativa dentro del relato histórico contemporáneo colombiano, a la luz de sus relaciones transversales. Tras el Acuerdo de Contribución a la Verdad Histórica y la Reparación y de la consolidación del trabajo llevado a cabo por el Centro Nacional de Memoria Histórica iniciado hace casi una década con su primer informe, es pertinente volver sobre algunas ideas relacionadas con la manera en la que se narra la historia en Colombia. En este sentido, se constata el valor histórico de la ficción, así como la vitalidad de sus diversos actores sociales y culturales, en sus intersecciones y recorridos por la memoria colectiva, en su materialidad y en su reinvención histórica. Los textos de ficción, por tanto, ofrecen caminos de reinvención de los relatos históricos, que no los sustituyen, pero sí empoderan a sus participantes/enunciantes, sus lectores/receptores y sus versiones/ relatos dentro de los procesos de memorias nacionales y humanas de la Colombia de hoy. Lo significativo de esta propuesta radica en que estos relatos son inclusivos, plurales y carecen del juicio moral hecho por una voz narradora autoritaria y única. (shrink)

Recently, a number of philosophers have begun to question the commonly held view that choice or voluntary control is a precondition of moral responsibility. According to these philosophers, what really matters in determining a person’s responsibility for some thing is whether that thing can be seen as indicative or expressive of her judgments, values, or normative commitments. Such accounts might therefore be understood as updated versions of what Susan Wolf has called “real self views,” insofar as they attempt to ground (...) an agent’s responsibility for her actions and attitudes in the fact (when it is a fact) that they express who she is as a moral agent. As such, they seem to be open to some of the same objections Wolf originally raised to such accounts, and in particular to the objection that they cannot license the sorts of robust moral assessments involved in our current practices of moral responsibility. My aim in this paper is to try to respond to this challenge, by clarifying the kind of robust moral assessments I take to be licensed by (at least some) non-volitional accounts of responsibility and by explaining why these assessments do not in general require the agent to have voluntary control over everything for which she is held responsible. I also argue that the limited applicability of the distinction between “bad agents” and “blameworthy agents” on these accounts is in fact a mark in their favor. (shrink)

David Papineau’s _The Metaphysics of Sensory Experience_ is deep, insightful, refreshingly brisk, and very readable. In it, Papineau argues that sensory experiences are intrinsic and non-relational states of subjects; that they do not essentially involve relations to worldly facts, properties, or other items (though they do happen to correlate with worldly items); and that they do not have truth conditions simply in virtue of their conscious (i.e., phenomenal) features. I am in enthusiastic agreement with the picture as described so far. (...) But Papineau also argues that sensory experiences are in no interesting sense essentially representational and that what is responsible for their truth conditions is their correlations with the environment. Here, I disagree. Indeed, I think Papineau does not follow his arguments to their proper conclusions. For if sensory experiences are intrinsic, non-relational, and only contingently correlated with worldly conditions (as Papineau and I agree they are), then the phenomenal features of sensory states are representational in an important sense: they constitute what we think, perceptually experience, or otherwise entertain, making up how things seem to us from a first-person perspective. Because of this, the truth conditions of perceptual experiences cannot be entirely independent of their phenomenal features. They cannot merely be a matter of environmental correlations. If we follow Papineau’s arguments to their proper conclusions, we end up with a view much closer to a version of representationalism that Papineau dismisses, a view he calls “pure phenomenal intentionalism”. This article argues that resolutions are reason-giving: when an agent resolves to φ, she incurs an additional normative reason to φ. I argue that the reasons we incur from making resolutions are importantly similar to the reasons we incur from making promises. My account explains why it can be rational for an agent to act on a past resolution even if temptation causes preference and even judgment shifts at the time of action, and offers a response to a common objection (...) to the normativity of resolutions known as the bootstrapping problem, on which if resolutions were reason-giving they would problematically allow us to bootstrap any action into rationality simply by resolving to perform it. In pursuit of the dream that patients' exercise of autonomy could extend beyond their span of competence, living wills have passed from controversy to conventional wisdom, to widely promoted policy. But the policy has not produced results, and should be abandoned.

Propositionalism is the view that all intentional states are propositional states, which are states with a propositional content, while objectualism is the view that at least some intentional states are objectual states, which are states with objectual contents, such as objects, properties, and kinds. This paper argues that there are two distinct ways of understanding propositionalism and objectualism: (1) as views about the deep nature of the contents of intentional states, and (2) as views about the superficial character of the (...) contents of intentional states. I argue that we should understand the views in the second way. I also argue that the propositionalism debate is fairly independent from debates over the deep nature of intentionality, and that this has implications for arguments for propositionalism and objectualism from claims about the nature of intentional content. I close with a short discussion of how related points apply to the debate over singular content. (shrink)

The fate of optimality modeling is typically linked to that of adaptationism: the two are thought to stand or fall together (Gould and Lewontin, Proc Relig Soc Lond 205:581–598, 1979; Orzack and Sober, Am Nat 143(3):361–380, 1994). I argue here that this is mistaken. The debate over adaptationism has tended to focus on one particular use of optimality models, which I refer to here as their strong use. The strong use of an optimality model involves the claim that selection is (...) the only important influence on the evolutionary outcome in question and is thus linked to adaptationism. However, biologists seldom intend this strong use of optimality models. One common alternative that I term the weak use simply involves the claim that an optimality model accurately represents the role of selection in bringing about the outcome. This and other weaker uses of optimality models insulate the optimality approach from criticisms of adaptationism, and they account for the prominence of optimality modeling (broadly construed) in population biology. The centrality of these uses of optimality models ensures a continuing role for the optimality approach, regardless of the fate of adaptationism. (shrink)

There is an apparent tension in our everyday moral responsibility practices. On the one hand, it is commonly assumed that moral responsibility requires voluntary control: an agent can be morally responsible only for those things that fall within the scope of her voluntary control. On the other hand, we regularly praise and blame individuals for mental states and conditions that appear to fall outside the scope of their voluntary control, such as desires, emotions, beliefs, and other attitudes. In order to (...) resolve this apparent tension, many philosophers appeal to a tracing principle to argue that agents are morally responsible for those attitudes whose existence can be traced back, causally, to a voluntary action or omission in the past. My aim in this article is to critically evaluate this tracing strategy and to argue that it gives us a misguided picture of when and why we are morally responsible for our attitudes. I argue that we should accept a ‘judgment sensitivity’ condition of moral responsibility rather than a ‘voluntary control’ condition, and defend this account against various objections. (shrink)

Over the past few decades, the dominant approach to explaining intentionality has been a naturalistic approach, one appealing only to non-mental ingredients condoned by the natural sciences. Karen Neander’s A Mark of the Mental (2017) is the latest installment in the naturalist project, proposing a detailed and systematic theory of intentionality that combines aspects of several naturalistic approaches, invoking causal relations, teleological functions, and relations of second-order similarity. In this paper, we consider the case of perceptual representations of colors, which (...) is a challenging case for Neander’s theory. This case will brings out a general methodological concern with Neander’s and other naturalistic theories: these theories generally rest on the assumption that the mental intentionality we are acquainted with in everyday life—the phenomenon exhibited by desires for cups of coffee, perceptual experiences of dogs playing in yards, and thoughts about the weather—is the very same kind of phenomenon that cognitive science studies under labels such as “mental representation” and, in some cases, “information processing.” This assumption is dubious, as the case of Neander’s theory illustrates. The most pressing worry for panpsychism is arguably the combination problem, the problem of intelligibly explaining how the experiences of microphysical entities combine to form the experiences of macrophysical entities such as ourselves. This chapter argues that the combination problem is similar in kind to other problems of mental combination that are problems for everyone: the problem of phenomenal unity, the problem of mental structure, and the problem of new quality spaces. The ubiquity of combination problems suggests the ignorance hypothesis, (...) the hypothesis that we are ignorant of certain key facts about mental combination, which allows the panpsychist to avoid certain objections based on the combination problem. I argue for the unity of imagination in two prima facie diverse contexts: experiences of beauty and achievements of understanding. I develop my argument in three steps. First, I begin by describing a type of aesthetic experience that is grounded in a set of imaginative activities on the part of the person having the experience. Second, I argue that the same set of imaginative activities that grounds this type of aesthetic experience also contributes to achievements of understanding. Third, I show (...) that my unified account of imagination has important implications: it sheds light on two puzzling phenomena, the aesthetic value of science and the cognitive value of art. Perceptual experiences seem to in some sense have singular contents. For example, a perceptual experience of a dog as fluffy seems to represent some particular dog as being fluffy. There are important phenomenological, intuitive, and semantic considerations for thinking that perceptual experiences represent singular contents, but there are also important phenomenological, epistemic, and metaphysical considerations for thinking that they do not. This paper proposes a two-tier picture of the content of singular perceptual experiences that is based on phenomenal intentionality theories (...) of intentionality combined with self-ascriptivism about derived representation, a combination of views that allows mental states to have two types of contents: phenomenal contents and derived contents. On the proposed picture, singular perceptual experiences represent singular phenomenal contents, which do not involve worldly objects, as well as singular derived contents, which do involve worldly objects. This article argues that consent must be revocable. I present two arguments for this conclusion. On the argument from informed consent, irrevocable consent lacks validity because it cannot be sufficiently informed. On the argument from bodily integrity, irrevocable consent lacks validity because we do not have the authority to deny our future selves the ability to protect our bodily integrity. I explain why the argument from bodily integrity captures unique moral problems raised by irrevocable consent and illuminates an important but (...) undertheorized distinction between autonomy and bodily integrity. This paper contends that a research ethics approach to the regulation of health data research is unhelpful in the era of population‐level research and big data because it results in a primary focus on consent (meta‐, broad, dynamic and/or specific consent). Two recent guidelines – the 2016 WMA Declaration of Taipei on ethical considerations regarding health databases and biobanks and the revised CIOMS International ethical guidelines for health‐related research involving humans – both focus on the growing reliance on health data (...) for research. But as research ethics documents, they remain (to varying degrees) focused on consent and individual control of data use. Many current and future uses of health data make individual consent impractical, if not impossible. Many of the risks of secondary data use apply to communities and stakeholders rather than individual data subjects. Shifting from a research ethics perspective to a public health lens brings a different set of issues into view: how are the benefits and burdens of data use distributed, how can data research empower communities, who has legitimate decision‐making capacity? I propose that a public health ethics framework – based on public benefit, proportionality, equity, trust and accountability – provides more appropriate tools for assessing the ethical uses of health data. The main advantage of a public health approach for data research is that it is more likely to foster debate about power, justice and equity and to highlight the complexity of deciding when data use is in the public interest. Can aesthetic judgements legitimately be linked to the success of scientific theories? I suggest that a satisfactory answer to this question should account for the persistent attraction that aesthetic considerations seem to have for scientists, while also explaining the apparent instability of the link between the beauty of a theory and its truth. I argue that two widespread tendencies in the literature, Pythagorean and subjectivist approaches, have difficulties meeting this twofold challenge. I propose a Kantian conception of aesthetic judgements as (...) second‐order considerations, related to our own intellectual capacities for making sense of the world, and argue that it fares better. According to Lynne Rudder Baker’s Practical Realism, we know that we have beliefs, desires, and other propositional attitudes independent of any scientific investigation. Propositional attitudes are an indispensable part of our everyday conception of the world and not in need of scientific validation. This paper asks what is the nature of the attitudes such that we may know them so well from a commonsense perspective. I argue for a self-ascriptivist view, on which we have propositional attitudes in virtue of ascribing (...) them to ourselves. On this view, propositional attitudes are derived representational states, deriving their contents and their attitude types from our self-ascriptions. (shrink)

This article examines the future of social security in emerging economies, exploring the key challenges facing these countries and proposing potential solutions. Financial sustainability, universal coverage and equity are some of the main obstacles that must be overcome to ensure a robust and fair social security system. Through a literature review and case analysis, proposals are presented to improve the effectiveness and sustainability of these systems in the context of emerging economies.

Throughout March and April 2020, debate raged about how best to allocate limited intensive care unit (ICU) resources in the face of a growing COVID-19 pandemic. The debate was dominated by utility-based arguments for saving the most lives or life-years. These arguments were tempered by equity-based concerns that triage based solely on prognosis would exacerbate existing health inequities, leaving disadvantaged patients worse off. Central to this debate was the assumption that ICU admission is a valuable but scarce resource in the (...) pandemic context.In this paper, we argue that the concern about achieving equity in ICU triage is problematic for two reasons. First, ICU can be futile and prolong or exacerbate suffering rather than ameliorate it. This may be especially true in patients with COVID-19 with emerging data showing that most who receive access to a ventilator will still die. There is no value in admitting patients with poor prognostic indicators to ICU to meet an equity target when intensive critical care is contrary to their best interests. Second, the focus on ICU admission shifts focus away from important aspects of COVID-19 care where there is greater opportunity for mitigating suffering and enhancing equitable care.We propose that the focus on equity concerns during the pandemic should broaden to include providing all people who need it with access to the highest possible standard of end-of-life care. This requires attention to culturally safe care in the following interlinked areas: palliative care, communication and decision support and advanced care planning. (shrink)

The purpose of this study is to examine how faith-led practices in family firms affect organizational stewardship. Current studies highlight the relevance of religious adherence for family businesses, yet provide limited understanding of how this shapes the key traits of these organizations. Drawing on six autobiographies of family business leaders who openly express their adherence to their faith, and adopting an open-systems analysis of these autobiographies, we demonstrate that faith-led values influence organizational and leadership practices. Overall, our study suggests that (...) the influence of religious beliefs in the organizational practices of family businesses have greater repercussions than previously thought. By introducing a faith-led approach to stewardship, we enrich the theoretical discussion around stewardship and the relevance of religion in family business. (shrink)

This article presents a critical account of Agamben’s understanding of the logic of sovereignty and of the notion bare life, particularly Agamben’s approach to the paradox of sovereignty and its relation to Aristotle’s metaphysical category of potentiality. With regards to bare life, it brings together an analysis of the figure of the homo sacer with an account of Agamben’s use of paradigms as methodological tools. The first part of the paper argues that Agamben ontologises sovereignty by dramatising the paradox of (...) its structure as im-potentiality. The second part claims that even though an account of Agamben’s methodology serves to respond to the different critiques that his notion of bare life has raised, Agamben’s notions of sovereignty and of bare life ultimately rely on Schmitt’s decisionism. El artículo hace un recuento crítico de la forma en que Agamben entiende la lógica de la soberanía y la noción de nuda vida, particularmente su abordaje de la paradoja de la soberanía y su relación con la categoría metafísica aristotélica de la potencialidad. Con respecto a la nuda vida, combina el análisis de la figura del homo sacer con un recuento del uso que hace Agamben de los paradigmas como herramientas metodológicas. En la primera parte del ensayo, se argumenta que Agamben ontologiza la soberanía al dramatizar la paradoja de su estructura como im-potencialidad. En la segunda, se afirma que aunque la descripción de la metodología de Agamben sirve para responder a las diferentes críticas suscitadas por su noción de nuda vida, sus nociones de soberanía y de nuda vida dependen, en última instancia, del decisionismo de Schmitt. Este artigo apresenta a versão crítica do entendimento de Agamben sobre a lógica da soberania e da noção de vida nua. In this paper I discuss two questions. What does Kant understand by mechanical explanation in the Critique of judgment? And why does he think that mechanical explanation is the only type of the explanation of nature available to us? According to the interpretation proposed, mechanical explanations in the Critique of judgment refer to a particular species of empirical causal laws. Mechanical laws aim to explain nature by reference to the causal interaction between the forces of the parts of matter and (...) the way in which they form into complex material wholes. Just like any other empirical causal law, however, mechanical laws can never be known with full certainty. The conception according to which we can explain all of nature by means of mechanical laws, it turns out, is based on what Kant calls ‘regulative’ or ‘reflective’ considerations about nature. Nothing in Kant’s Critique of judgment suggests that these considerations can ever be justified by reference to how the natural world really is. I suggest that what, upon first consideration, appears to be a thoroughly mechanistic conception of nature in Kant is much more limited than one might have expected. (shrink)

Philip Woodward's review of The Phenomenal Basis of Intentionality (PBI) raises objections to the specific version of the phenomenal intentionality theory proposed in PBI, especially to identity PIT, representationalism, the picture of derived mental representation, some tentative proposals regarding intentional structure, and the matching theory of truth and reference. In this reply, I argue that the version of PIT defended in PBI can withstand these objections.

In his Kant on Laws, Eric Watkins presents an account of reason on which the principles of specification and continuity are regulative instructions to search for different kinds of the unconditioned. I suggest that we correct Watkins’ account in two ways. First, we need to complete Watkins’ claim to the plurality of the unconditioned: reason aims for three kinds of the unconditioned, associated with the lowest, next and highest concepts. Second, we need to look beyond reason’s search for the unconditioned (...) in order to properly understand the nature of the aim of reason. I argue that we construe reason’s aim as the systematic unity of cognition considered as a whole or, in Kant’s teleological terms, as the realization of an ‘idea’, or a ‘purposive unity’. (shrink)

This paper aims to show that to reduce the level of exploitation present in (some) international clinical trials, research sponsors must aim to provide both an ex-ante expected gain in utility and a fair ex-post distribution of benefits for research subjects. I suggest the following principles of fair risk distribution in international research as the basis of a normative definition of fairness: (a) Persons should not be forced (by circumstance) to gamble in order to achieve or protect basic goods; (b) (...) In cases where one party is gambling with basic goods and the other party is not, the distribution of benefits and burdens must be arranged so that they are of greatest benefit to the worst off; (c) In relationships where one party is gambling for basic goods and the other party is not, the party gambling for basic goods must be assured of some guaranteed benefits in addition to the chance of gaining some potential benefits.These principles are applied to the case of HIV international research. I conclude that the research (as described) is mutually advantageous but still exploitative because the distribution of surplus benefits is unfair. It is unfair because research subjects are gambling with and for basic goods but they are not assured of a fair ex-post distribution of benefits. Principles (b) and (c) are not satisfied. Research participants are not accorded enough guaranteed benefits to outweigh the risks they undertake. (shrink)

When we evaluate artworks, we often point to what an artist could have done or what a work could have been in order to say something about the work as it actually is. Call this counterfactual reasoning in art criticism. On my account, counterfactual claims about artworks involve comparative aesthetic judgments between actual artworks and hypothetical variations of those works. The practice of imagining what an artwork could have been is critically useful because it can help us understand how artworks (...) achieve specific aesthetic effects. I conclude by responding to an objection to my account on the basis that it violates the widely accepted acquaintance principle in aesthetics, on which aesthetic judgments must be based on firsthand perceptual encounters with their objects. This paper examines the US Atomic Energy Commission’s radioisotope distribution program, established in 1946, which employed the uranium piles built for the wartime bomb project to produce specific radioisotopes for use in scientific investigation and medical therapy. As soon as the program was announced, requests from researchers began pouring into the Commission’s office. During the first year of the program alone over 1000 radioisotope shipments were sent out. The numerous requests that came from scientists outside the United States, however, sparked (...) a political debate about whether the Commission should or even could export radioisotopes. This controversy manifested the tension between the aims of the Marshall Plan and growing US national security concerns after World War II. Proponents of international circulation of radioisotopes emphasized the political and scientific value of collaborating with European scientists, especially biomedical researchers. In the end, radioisotopes were shipped from the Commission’s Oak Ridge facility to many laboratories in England and continental Europe, where they were used in biochemical research on animals, plants, and microbes. However, the issue of radioisotope export continued to draw political fire in the United States, even after the establishment of national atomic energy facilities elsewhere. (shrink)

The proposal of the ‘Anthropocene’ as a new geological epoch where humans represent the dominant natural force has renewed artistic interest in the ‘geopoetic’, which is mobilized by cultural producers to incite changes in personal and collective participation in planetary life and politics. This article draws attention to prior engagements with the geophysical and the political: the work of Simone Weil and of the editors of the Martinican cultural journal Tropiques, Suzanne and Aimé Césaire. Synthesizing the political and scientific shifts (...) in human-world relationships of their time, both projects are set against oppressive or narcissistic materialisms and experiment with the image of the ‘cosmic’ to cultivate a preoccupation not (only) with a tangible materialism but with an intangible one that emphasizes process and connectivity across wide spatial and temporal scales. In their response to ‘Public interest in health data research: laying out the conceptual groundwork’, Grewal and Newson critique us for inattention to the law and putting forward an impracticably broad conceptual understanding of public interest. While we agree more work is needed to generate a workable framework for Institutional Review Boards/Research Ethics Committees, we would contend that this should be grounded on a broad conception of public interest. This broadness facilitates regulatory agility, and is already reflected by some current (...) frameworks such as that found in the guidelines approved under Australia’s Privacy Act. It remains unclear which elements of our broad account Grewal and Newson would reject, or indeed where the substantive disagreement with our position lies. (shrink)

When the Toxic Substances Control Act was passed by the US Congress in 1976, its advocates pointed to new generation of genotoxicity tests as a way to systematically screen chemicals for carcinogenicity. However, in the end, TSCA did not require any new testing of commercial chemicals, including these rapid laboratory screens. In addition, although the Environmental Protection Agency was to make public data about the health effects of industrial chemicals, companies routinely used the agency’s obligation to protect confidential business information (...) to prevent such disclosures. This paper traces the contested history of TSCA and its provisions for testing, from the circulation of the first draft bill in the Nixon administration through the debates over its implementation, which stretched into the Reagan administration. The paucity of publicly available health and environmental data concerning chemicals, I argue, was a by-product of the law and its execution, leading to a situation of institutionalized ignorance, the underside of regulatory knowledge. Many clinical ethics support services do not involve patients. This is surprising because of the broad commitment to provide patient-centered healthcare. Clinical ethics support services are a component of the healthcare system and have an influence on patient care, and should therefore align with the regulatory and ethical requirements of patient-centered care, just process and cultural competence. First, in order to achieve good patient care, it is essential to involve patients in making their own healthcare decisions. Second, just ethical deliberation (...) requires that the deliberating parties have access to complete, accurate and unbiased information – this is best achieved through direct patient input. These arguments are especially compelling in the case of non-dominant cultural and ethnic groups. Here, we argue that when a clinician refers a case to a clinical ethics support services for consideration, and that case involves a conflict between the views or values of the clinician and the patient, the patient is entitled to, at a minimum: (a) be informed of the referral; (b) have the opportunity to speak directly to the clinical ethics support services prior to deliberation; (c) be provided with any opinion directly from the clinical ethics support services; and (d) have the opportunity to speak to a clinical ethics support services member after the deliberation. We use New Zealand as a case study to support and extrapolate the ethical principles and the minimum patient involvement requirements. We draw on our empirical research with senior doctors at a tertiary New Zealand hospital. Clinicians in our study indicated that they would feel bound by clinical ethics support service advice and that the clinical ethics support service has a significant impact on patient care in the case it reviews.
